Commercial Property for Sale vs for Rent in Dubai: 2026 Guide

Whether to buy or lease an office, shop or warehouse in Dubai comes down to cash, control and flexibility. Here is how the two routes differ on cost, legal protection and exit, using the rules that apply on the Dubai mainland.

Buying: Upfront Costs and Where You Can Own

Foreign buyers can own freehold property in Dubai's designated zones, and published guides count more than 40 of them. Confirm that the specific building sits in a freehold zone before you make an offer, and check the title with the Dubai Land Department (DLD).

The standard DLD transfer fee is 4% of the purchase price. On top of that, expect a title deed fee (around AED 580 for apartments and offices), a registrar trustee fee (AED 2,000 plus 5% VAT below AED 500,000, AED 4,000 plus 5% VAT above), and agent commission, commonly 2% plus VAT on the buyer's side. Fee schedules change, so ask your adviser for a written breakdown for your deal.

Financing a Purchase

Non-resident buyers typically face tighter lending than residents. Published guides put non-resident loan-to-value at roughly 50–65%, against 75–80% for residents, which means a down payment of 35–50% in many cases. Banks also treat commercial units differently from homes, so get a term sheet early rather than assuming residential terms apply.

Leasing: The Legal Framework

Commercial leases on the mainland fall under Law No. 26 of 2007, as amended by Law No. 33 of 2008. Registration on Ejari is mandatory, and a tenant cannot file a dispute without a registered contract. Ejari is also tied to trade licence renewal, so an unregistered lease creates a licensing problem as well as a legal one.

Unless you agree otherwise, the statutory default is payment in four equal instalments in advance, though one or two cheques are common in practice and negotiable. Commercial rent also carries 5% VAT, which residential rent does not. Budget for it, and check whether your business can recover it.

Rent Increases, Notice and Fit-Out

At renewal, rent increases are capped by RERA's rental index according to how far the current rent sits below the market benchmark, with the maximum rise reaching 20% in the widest-gap bracket. Landlords must give at least 90 days' notice of an increase before the lease ends, and eviction for the landlord's own use or renovation needs 12 months' written notice.

Fit-out is a common trap. By default, improvements you build belong to the landlord and cannot be removed unless the lease says otherwise. If you plan a costly fit-out, negotiate a longer term, a rent-free period or a clause covering what happens to the improvements at exit.

Disputes

Disputes over registered commercial leases go to the Rental Dispute Settlement Centre (RDSC), which starts with mediation before a tribunal hearing. Filing fees are around 3.5% of annual rent, subject to a minimum and maximum, so read the current fee schedule before you file.

Checks Before You Sign

Whether you buy or lease, verify the basics: the permitted use of the unit (office, retail or industrial) against your trade licence activity, the service charges you will owe, the parking allocation, and the condition of the space at handover. Ask for a documented condition report, because the security deposit rules set no statutory percentage cap or return deadline, so your protection is largely what the contract and your paperwork say.

For a lease, also confirm the landlord's title and authority to let, the lease term and any break clause, and who pays for maintenance and fit-out reinstatement. For a purchase, confirm any existing tenancy transfers with the unit, and ask whether the building has an owners' association and what it charges. Getting these answers in writing early saves time and money later.

Which Route Suits You?

Buying tends to suit owners with long horizons who want to build equity or collect rent, and who can absorb about 4% in transfer costs plus fees. Leasing suits growing businesses, first-year setups and anyone who wants cash in the operation rather than in property. Neither is better in general: compare the total cost over your expected holding period, including fees, VAT, service charges and fit-out, rather than headline rent against price.

Whichever way you lean, check the trade licence and free zone position too. Some free zones have their own leasing regimes, so the rules above apply to mainland premises specifically.
