Dubai Tenancy Contract: Clauses Tenants Should Read Before Signing

A Dubai tenancy contract is short, but each line decides who pays, who fixes and what happens if either side wants out. Tenants who sign without reading often learn this at renewal or move-out.

This guide walks through the clauses worth reading closely before you sign or renew, and the checks that protect you. It uses no rent figures, because rents and rules change.

Start With Who Is Who

Check the landlord's name against the title deed or a copy of it, and confirm that the person signing is the owner or holds a valid power of attorney. If an agent is involved, ask for their Trakheesi permit and broker card number. A tenancy with the wrong party can leave you without protection.

Property and Term

The unit number, building, community and plot details should match the title deed and the Ejari record.
The start and end dates, so that you know the renewal date and the 90-day notice window. See Dubai Rent Increases Explained.
The permitted use, residential or otherwise.

Rent and How You Pay It

The annual rent and how many cheques the landlord will accept. More cheques usually help your cash flow, but landlords may ask for a higher rent in return.
Cheque dates and amounts, written clearly. Note what happens if a cheque is late or returned.
Any other payments, such as the agent fee, the security deposit and administration charges. Ask for each in writing.

Deposit

Confirm the amount, who holds it and when it is returned. Our guide to Dubai security deposits explains what landlords can deduct and how to protect your return. Photograph the property at move-in and keep a dated inventory.

Maintenance and Repairs

Which repairs are the landlord's and which are the tenant's. Major structural and systems repairs normally fall to the landlord, with minor upkeep falling to the tenant, but the contract should say so.
Who pays for the air-conditioning servicing and for district cooling charges, if the building uses them.
How to report a fault, and the time within which it should be fixed.

Utilities and Charges

Check who pays for electricity, water, cooling, internet and any service charges that are passed on. Ask whether the DEWA connection is in your name, and whether any outstanding balance exists on the unit.

Early Exit and Break Clauses

Ask what happens if you need to leave before the end of the term. Some contracts set a fixed penalty, often expressed as a number of months' rent. A clear, reasonable break clause is worth more than a slightly lower rent.

Subletting, Guests and House Rules

Most tenancies prohibit subletting without the landlord's consent. Read Subletting a Rented Home in Dubai before you rely on it. Also ask whether the building limits the number of occupants or has rules on pets.

Ejari Registration

The tenancy should be registered on Ejari, and the landlord or agent normally arranges it with the tenant's documents. Check that the Ejari certificate shows the same unit and dates as the contract. Registration is what gives the tenancy standing before the rental dispute authorities.

Before You Sign: A Quick Checklist

Read the contract in full, including any addendum.
Do not sign blank cheques or incomplete forms.
Get a copy of everything you sign.
Keep proof of every payment.
Ask for changes in writing and have them added to the contract.
