Subletting a Rented Home in Dubai: Landlord Consent, Ejari and the Risks

Subletting means renting out all or part of a home that you yourself rent. In Dubai it is possible, but it is tightly controlled, and doing it without the right paperwork can put your own tenancy at risk.

This guide explains the principles for tenants and landlords: why written consent comes first, how Ejari registration fits in, and what can go wrong.

The short answer

Dubai's tenancy law generally requires the landlord's written consent before a tenant sublets. Without it, subletting can be treated as a breach of the tenancy contract, and the landlord may have grounds to take action. Get the consent in writing, register the arrangement correctly, and keep records.

Where the rules come from

Residential tenancies in Dubai are governed by Law No. 26 of 2007 as amended, and the rules are applied through the Real Estate Regulatory Agency (RERA) and the Rental Disputes Centre, which are part of the Dubai Land Department. Tenancy contracts are registered on Ejari. Ask the Dubai Land Department or a qualified lawyer how the current rules apply to your case, because details can change.

Step by step if you want to sublet

Read your tenancy contract. Look for any clause on subletting or assigning the lease.
Ask your landlord in writing. State what you want to sublet (the whole unit or a room), for how long and to whom.
Get the answer in writing. A verbal yes is not enough.
Register the new arrangement. Ask the Dubai Land Department or a licensed typing centre how a sub-tenancy is registered on Ejari.
Put a sub-lease in writing. It should state the rent, the term, who pays utilities and what the sub-tenant may do.

Risks for the tenant

You stay responsible to your landlord. If the sub-tenant stops paying or damages the unit, you still owe the landlord.
Building rules. The owners' association or building management may restrict who can live there and how many people.

Eviction risk. A breach of the contract can give the landlord a reason to end the tenancy, subject to the legal notice rules.

Risks for the sub-tenant

If you are the sub-tenant, check that the person subletting to you has the landlord's written consent and ask to see it. Without it, you could be asked to leave at short notice and could find it hard to recover your deposit. Ask who holds your security deposit and how you get it back. For landlords

If a tenant asks to sublet, you can say no, say yes with conditions, or ask for a new contract with the new occupant. Whatever you decide, record it in writing and make sure Ejari matches who is actually living in the property. Mismatches create disputes later.
